These Terms & Conditions (“Terms”) govern your access to and use of the Get Fruity Cafe website, online ordering platform, and related services (collectively, the “Services”), including our Get Fruity Rewards program and SMS text messaging program. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Eligibility

You must be at least 13 years old to use our Services. By using our Services, you represent that you meet this requirement and that all information you provide to us is accurate and complete.

2. Use of the Website and Ordering Services

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to misuse our Services, interfere with their operation, or attempt to access them using a method other than the interface we provide.

3. Account Registration & Get Fruity Rewards

Certain features, including Get Fruity Rewards, require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Get Fruity Rewards points, offers, and benefits have no cash value, are non-transferable, may expire, and may be modified or discontinued at our discretion, subject to applicable law.

4. Orders, Pricing & Payment

All menu items, prices, and availability are subject to change without notice.
We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or product unavailability.
Payment is processed through third-party payment processors; by placing an order, you authorize the applicable charges to your selected payment method.
Taxes, delivery fees, and service fees may apply and will be disclosed at checkout.

5. Delivery & Third-Party Delivery Platforms

Orders placed through third-party delivery platforms (such as DoorDash, Uber Eats, Grubhub, or similar services) are also subject to that platform’s own terms of service and privacy policy. Get Fruity Cafe is not responsible for delays, order errors, or service issues caused by third-party delivery platforms or drivers.

6. SMS / Text Messaging Terms

By opting in to our SMS text messaging program (including Get Fruity Rewards text alerts), you agree to the following:

You consent to receive recurring, automated marketing and informational text messages from Get Fruity Cafe at the mobile number you provide, including messages about promotions, rewards, and order updates.
Consent to receive text messages is not a condition of purchasing any goods or services.
Message frequency varies. Message and data rates may apply.
You may opt out at any time by replying STOP to any message; you will receive one final confirmation message. Reply HELP for assistance, or contact info@mygetfruity.com or (470) 696-2329.
Supported carriers are not liable for delayed or undelivered messages.
You represent that you are the account holder or authorized user of the mobile number you provide, and that you have the authority to consent to receive text messages at that number.

7. Promotions and Rewards Terms

Specific promotions, contests, or rewards offers may be subject to additional terms disclosed at the time of the offer. In the event of a conflict, those additional terms will govern the specific promotion.

8. Intellectual Property

All content on our website, including text, graphics, logos, and the Get Fruity Cafe name and branding, is owned by or licensed to Get Fruity Cafe and is protected by intellectual property laws. You may not copy, reproduce, or use our content without prior written permission.

9. User Conduct

You agree not to: (a) violate any applicable law or regulation; (b) impersonate any person or entity; (c) interfere with or disrupt our Services; (d) attempt to gain unauthorized access to our systems; or (e) use our Services to transmit unlawful, abusive, or fraudulent content.

Our Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that our website will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, Get Fruity Cafe will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these Terms will not exceed the amount you paid to us, if any, in the transaction giving rise to the claim.

You agree to indemnify and hold harmless Get Fruity Cafe, its officers, employees, and agents from any claims, damages, or expenses arising out of your use of our Services or your violation of these Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws principles. Any dispute arising out of these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia.

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
